Terms and Conditions of Sale

1. GENERAL DISPOSITION

  • 1.1. The following terms and conditions of sale apply to the catalog and sale of products through the website https://dsddeluxe.com
  • 1.2. To purchase products on the Website, customers must: (a) be at least 18 years old; (b) be consumers, understood as natural persons acting for purposes outside their trade, business, or profession; (c) register on the Website; and (d) have a valid credit card.
  • 1.3. This purchase agreement shall be formalized in Spanish or English and governed by Spanish law, including Royal Legislative Decree 1/2007 of November 16, approving the revised text of the General Law for the Defense of Consumers and Users ("Consumer Law"), and Law 34/2002 of July 11, on Information Society Services and Electronics Commerce ("LSSI").

2. SELLER IDENTIFICATION

  • 2.1. The seller is DSD PHARM S.L. ("Company"), a Spanish company, with registered office at Calle Francia 18A, Polígono Industrial Pla de Llerona, 08520 Les Franqueses del Vallés, BARCELONA, SPAIN.

3. PRODUCTS

  • 3.1. The Website publishes information about the products offered by the brand DSD de Luxe in its sales catalog, which the Company supplies in accordance with Articles 60, 63 and 97 of the Consumer Law, and Articles 27 and 28 of the LSSI.
  • 3.2. The Company shall take all reasonable precautions to ensure that all details, descriptions, and images of the products appearing on the Website are accurate at the time they are entered into the system. However, to the extent permitted by applicable law, the Company does not warrant that such details, descriptions, and images are accurate, complete, reliable, up to date, or error-free.
  • 3.3. The products described on the Website, as well as any samples thereof that the Company may provide to the customer, are for personal use only. Customers may not sell or resell any such products or samples. The Company reserves the right, with or without notice, to cancel or reduce the quantity of any products or samples to be delivered to the customer if, at its sole discretion, it believes this constitutes a violation of these Terms and Conditions.

4. PRICE

  • 4.1. All prices for products available through the Website include applicable VAT according to current rates and are expressed in euros. Shipping costs will be added to the product price and indicated separately in the order.
  • 4.2. The Company regularly checks the accuracy of all prices displayed on the Website; however, to the extent permitted by applicable law, it cannot guarantee that there are no errors. If an obvious pricing error is found, the Company will offer the customer the option to purchase the product at the correct price or to cancel the order.

5. ORDER PLACEMENT

  • 5.1. To place an order, the customer must follow a series of simple instructions displayed on the Website.
  • 5.2. Our order processing system allows customers to review and correct any errors before confirming the order. It is strongly recommended that customers take the necessary time to carefully read and verify all information at each step of the registration process.
  • 5.3. By clicking "I have read and accept the general terms of sale" and continuing with the order process by clicking "next", the customer commits to purchasing and paying for the products in their order. The purchase is subject to these General Terms of Sale. By placing an order, the customer confirms that they accept these Terms and Conditions of Sale.
  • 5.4. The customer must click on "Add to cart" to place the selected product in the desired quantity in the shopping cart. The customer may check the products included in the cart at any time by clicking "Cart".
  • 5.5. The customer must follow the on-screen instructions to complete their order process. The customer may always correct any input error, modify the cart contents by adding or removing one or more products, or cancel the entire order during the process. The customer finalizes an order for products through the Website by clicking on the "Accept" button at the end of the order process.
  • 5.6. Once the order is completed, you will receive an order confirmation email.
  • 5.7. If the order confirmation is not received within 24 hours after order submission, the customer should contact customer service for assistance via email at info@dsddeluxe.com or via WhatsApp.

6. PROMOTIONAL CODES

  • 6.1. To redeem a promotion code, the customer must enter their code in the "promotional code" box during checkout on the website. Promotional codes are case-sensitive and must always be entered as they appear.
  • 6.2. Only one promotional code may be used per order.

7. PAYMENT OPTIONS

  • 7.1. The customer may pay for products by credit card. The following cards are accepted:
    • Visa
    • MasterCard
    • PayPal
  • 7.2. When placing an order through our Website, you authorize us to carry out credit, fraud, and payment method verification checks. These checks may be necessary, among other things, to verify your identity, validate your credit card, and/or authorize individual purchases. In case of fraud, the matter will be referred to the legal department.
  • 7.3. In the event of any issue with processing or banking transactions associated with an order, we reserve the right not to ship the order until the issue has been resolved. This may include, but is not limited to, lack of payment authorization, failed transactions, verification issues, or any other matter related to the payment system used.

8. ORDER INQUIRIES

  • 8.1.
    • SPAIN: The approximate delivery time is 5 business days. We prepare your order within 24-48 hours, and once shipped, transport takes between 24-48 hours to reach any point in Spain* (excluding the Canary Islands).
    • EUROPE: Outside Spain, the delivery time may be extended by approximately 3 days*.
    • United Kingdom, Norway, Switzerland and Monaco: Delivery may take longer due to customs clearance procedures.
    • *Deliveries to islands may take longer due to their geographical location.
    • IMPORTANT: During special campaign periods such as Christmas, delivery times may be longer than usual.
  • 8.2. To obtain information about your order, you can check your Order History through My Account. If you require additional information, please contact us via info@dsddeluxe.com or WhatsApp.
  • 8.3. When the customer clicks on the Order Status section, they will be asked to log in using their email address and password. The summary page will provide detailed information about their current and past orders.

9. DELIVERY

  • 9.1. For successful delivery:
    • (i) It is important to complete the order form with the full delivery address, including street, number, floor or house, postal code, and city. The user is responsible for the accuracy of the information provided to the Company.
    • (ii) A contact telephone number must be provided.
  • 9.2. The delivery process is carried out only on business days (Monday to Friday, excluding public holidays and weekends).
  • 9.3. If any delivery takes longer than the established period, please contact Customer Service for assistance at info@dsddeluxe.com or via WhatsApp.
  • 9.4. Please note that all packages leaving our facilities are in perfect condition, equipped with visible security seals, which must be intact upon receipt.
  • 9.5. If, at the time of delivery, it is found that the packaging is damaged (box deteriorated or showing signs of prior opening), the customer must refuse delivery and immediately notify our Customer Service department.
  • 9.6. If an order for products placed through the Website is to be delivered to a country included in the international delivery list, such order may be subject to import duties and taxes applied when the shipment reaches its destination. The customer is responsible for paying any import duties and taxes that may apply. It is recommended that customers contact their local customs office before placing an international order to obtain detailed information.
  • 9.7. Orders will only be delivered to residential addresses. We do not deliver to pick-up points, carrier agency offices, or P.O. boxes.
  • 9.8. In the event that the customer receives the goods and subsequently forwards them to a different address, full responsibility for the reshipment shall rest exclusively with the customer. In the event of a claim regarding any issue with the contents of the package, it must be handled upon receipt of the goods at the original delivery address.

10. RIGHT OF WITHDRAWAL

  • 10.1. The Company is committed to offering its customers the highest-quality cosmeceutical products. If the customer considers that the received products do not meet their expectations, they have the right to withdraw from the order without providing any reason, within fourteen (14) business days from the date of receipt of the products, in accordance with Article 71 of the Consumer Protection Law.
  • 10.2. The Company will not accept returns based on withdrawal, except in exceptional cases of force majeure or when the products show manufacturing defects or damages attributable to the Company.
  • 10.3. In accordance with Article 103 - Exceptions to the Right of Withdrawal - of the General Law for the Defense of Consumers and Users (Law 3/2014), cosmeceutical products cannot be returned if they have been unsealed or opened, for hygiene and health reasons, in accordance with Spanish Law.

11. CLAIMS

  • 11.1. In the event of a claim, it must be reported within a maximum period of 14 calendar days from the delivery date by contacting our Customer Service via email at info@dsddeluxe.com or via WhatsApp.
  • 11.2. In the event of a claim due to damage or breakage, it must be reported within a maximum of 48 hours from the delivery date by contacting our Customer Service via email at info@dsddeluxe.com or via WhatsApp.

12. CUSTOMER SERVICE

  • 12.1. At DSD de Luxe we do not have a chatbox; we prefer to offer personalized customer service managed by our Customer Service team, with support from the Technical team whenever necessary.

13. YOUR PERSONAL INFORMATION

  • 13.1. Your data will be processed in accordance with Organic Law 3/2018 of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD), as well as current legislation on the protection of personal data.

14. CHANGES TO THESE TERMS AND CONDITIONS

  • 14.1. These Terms and Conditions will be updated whenever necessary.
  • 14.2. Each time you create an order, the Terms and Conditions in force at that time shall apply.

15. APPLICABLE LAW AND JURISDICTION

  • 15.1. These Terms and Conditions are governed by Spanish law and must be interpreted in accordance with Spanish law. This means that the purchase order for Products through our Website, and any dispute or claim arising from or in connection with it, shall be governed by Spanish law.
  • 15.2. You and We both agree that any disputes arising from the interpretation, validity and/or execution of these Terms and Conditions shall be submitted to the jurisdiction of the Courts of Barcelona, Spain.
