1. GENERAL DISPOSITION

  • 1.1. The following terms and conditions of sale ("Terms and Conditions of Sale") apply to the offer and sale of products through the website https://dsddeluxe.com ("Website").
  • 1.2. To be able to buy products on the Website, customers must:
    (a) At least 18 years old
    (b) Be consumer, understands as such natural persons who act for purposes unrelated to their industry, trade, business, and profession
    (c) Register with the website
    (d) Have a valid credit card.
  • 1.3. This contract will be formalized in Spanish and will be regulated by Spanish legislation, including Royal Decree 1/2007 of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users (“Ley of the Consumer ”) and Law 34/2002, of July 11, on Services of the Information Society and Electronic Commerce (“ LSSI ”).

  • 2.1. The seller is DSDPHARM S.L., a Spanish company, with registered office at Calle Holanda nº 44, Polígono Industrial Pla de Llerona, 08520 Les Franqueses del Vallés, BARCELONA, SPAIN.

3. PRODUCTOS

  • 3.1. Information about the Products is available on the Website and is provided in accordance with Articles 60, 63 and 97 of the Consumer Law and Articles 27 and 28 of the LSSI.
  • 3.2. We will take all reasonable care to ensure that all product details, descriptions and images appearing on the Website are correct at the time the relevant information is entered into the system; however, to the extent permitted by applicable law, we do not warrant that such product details, descriptions and images are accurate, complete, reliable, up to date or error-free.
  • 3.3. The products described on the Website and any samples thereof provided by us to the customer are for personal use only. Customers may not sell or resell such products or samples. We reserve the right, with or without notice, to cancel or reduce the quantity of products or samples to be delivered to the customer where, in our sole discretion, this would constitute a breach of these Terms and Conditions.

4. PRICE

  • 4.1. All prices indicated for the products that are available through the Website include VAT at the rates in force and are denominated in euros. Shipping costs will be added to the price of the products and are indicated separately on the order.
  • 4.2. We regularly check the correctness of all prices displayed on the Website, however, to the extent permitted by applicable law, we cannot guarantee the absence of errors. In the event of an obvious error in the price of a product, we will give the customer the opportunity to purchase the product at the correct price or to cancel the order.

5. ORDER PLACE

  • 5.1 To place an order, the customer must follow a series of simple instructions on the Website.
  • 5.2 Our order processing system allows you to review and resolve errors before proceeding to confirm your order. Please take the time to read and review your order for each page during the registration process. In particular, please check the quantities, sizes and weight of each Product in your order.
  • 5.3 By clicking on ‘I have read and accept the general terms and conditions of sale’ and continue with the ordering process by clicking on ‘next’, you are agreeing to purchase and pay for the Products in your order. The purchase order is subject to these General Conditions of Sale. By placing an order, you confirm that you accept these Terms and Conditions of Sale.
  • 5.4. The customer must click on ‘Add to basket’ to place the selected product and in the desired quantity in the shopping basket. The customer can check at any time during the purchase process which products are included in the shopping basket by clicking on ‘Cart’ on each page.
  • By placing an order, the customer acknowledges and declares that he/she has read all the instructions given during the checkout process and accepts these Terms and Conditions in their entirety. The customer places an order for products through the Website by clicking on the ‘Accept’ button at the end of the order process.
  • 5.5. Once the order has been submitted, you will receive a confirmation email.
  • 5.6. If the confirmation of an order does not arrive within 24 hours of its formalisation, the customer may contact us for assistance at +34 938467447 or info@dsddeluxe.com.
  • 5.7. Should customers have any questions or concerns when creating an order or if they wish to enquire about a previous order, they may contact us by email info@dsddeluxe.com or by telephone. For faster service, customers are invited to have their order number available.

6. PROMO CODE

  • 6.1. To redeem a promotion code, the customer must enter their code in the ‘promotion code’ box during the checkout process on the website. Promotion codes are case sensitive and must always be entered as they appear.
  • 6.2. One promotional code can be used per order.
  • 6.3. When you enter a promotion code, the promotion will be displayed in ‘Order Review’.

7. PAYMENT OPTIONS

  • 7.1. The customer may pay for the products by credit card. The following credit cards are accepted for this purpose:
    • Visa
    • MasterCard
    • And via the PayPal platform
  • 7.2. For the customer's security, the customer's name and billing address must match the credit card used for payment. We reserve the right to cancel any order that does not meet these criteria.
  • 7.3. By placing an order through our website, you authorise us to run a credit and anti-fraud check on the method of payment you are providing to us. These checks may be necessary, among other things, to verify your identity, to validate your credit card and/or to authorise individual purchases. In case of fraud, we will refer the case to the legal department.
  • 7.4. In the event of any problems with payment processing or banking transactions associated with an order, we reserve the right not to ship the order until the issue has been resolved. This may include, but is not limited to, failure to authorise payment, failed transactions, verification problems or any other issue relating to the payment system used. 

8. ORDER INQUIRIES

  • 8.1. 
    • SPAIN: The approximate delivery time is 5 business days. We prepare your order within 24-48 hours, and once shipped, it takes 24-48 hours to reach any point in Spain* (we don't delivery to Canary Islands).
    • EUROPE: Outside of Spain, the delivery time may be extended by up to approximately 3 days*.
    • United Kingdom, Norway, Switzerland and Monaco: the delivery may be extended due to Customs clearance.

                 *Deliveries to islands, due to its location, may need more time.

  • 8.2. To obtain information about a shipment, the customer can consult the Order History via My Account. If additional information is required, please contact us at info@dsddeluxe.com.
  • 8.3. When the customer clicks on the Order Status section, he/she will be asked to log in with his/her email address and password. On the order summary page the customer will be informed in detail about their current and previous orders.
  • 8.4. In the event that it is not possible to send a complete order or in the event of a duplicate order, we will contact the customer to inform him/her and resolve the situation.
  • 8.5. The order will be cancelled in case of:
    • Items not available
    • Inability to process payment information
    • Inability to deliver to the address provided.

9.DELIVERY

  • 9.1. To make a satisfactory delivery:
    • ( i ) It is very important that you provide a delivery address where we can find a person to deliver your order, during the morning or in the afternoon.
    • ( ii ) It is necessary to provide a contact telephone number.
    • ( iii ) We will need a person's name and ID card number.
  • 9.2. Orders are processed and delivered exclusively on working days (Monday to Friday, excluding public holidays and weekends). Orders placed on Saturday and Sunday will be processed on the next working day.

  • 9.4. We remind you that all packages leaving our facilities are in perfect condition, equipped with visible guarantee tapes and must be intact at the time of receipt.
  • 9.5. If, upon receipt of the Order, the packaging is found to be damaged (damaged box or with visible signs of having been opened), the Order must be rejected.
  • 9.6. In case of refusal of the package, please inform us via the Contact form as soon as possible. In the event that the package has been considered as ‘Accepted’ at the time of receipt by the recipient or authorised person, but there is hidden damage, you will have a time limit of 48 hours to inform us of this situation. Please contact our customer service team using the form on the Contact page of our website within this time period.
  • 9.7. Please be advised that if you place an order for products from our Website for delivery to one of the international delivery destinations, the Order may be subject to import duties and taxes, which apply when the delivery reaches its destination. You will be responsible for payment of any import duties and taxes. Please contact your local customs office for more information before placing your order to these international destinations.
  • 9.8. We are unable to process orders with a P.O. Box delivery address.

10. RIGHT OF WITHDRAWAL

  • 0.1. We are committed to providing customers with the best cosmetic products available. If the customer considers that the products he/she has received do not meet this expectation, he/she shall have the right to withdraw from the order, without giving any reason, within 7 (seven) working days from the date of receipt of the products, in accordance with article 71 of the Consumer Act.
  • 10.2. DSD de Luxe will not accept product returns for withdrawal from the purchase, except in exceptional cases of force majeure or when the product has manufacturing defects or damage attributable to us. Be sure to check the products carefully before making your purchase. In the event that there is a situation involving force majeure that prevents delivery or receipt of the product, we will evaluate each case individually to find the best solution. .
  • 10.3. According to Article 103-Exceptions to the right of withdrawal of the General Law for the Defence of the Rights of Consumers and Users (Law 3/2014): cosmetic products cannot be returned if they have been unsealed or opened, due to hygiene and health reasons, confirm to Spanish law.
  • 10.4. In case of return we kindly ask you to proceed according to the instructions detailed on the Return Policy.

 11. YOUR PERSONAL INFORMATION

  • 11.1 Your data will be processed in accordance with Organic Law 3/2018, of 5 December, on the Protection of Personal Data and Guarantee of Digital Rights (LOPDGDD), as well as current legislation on the protection of personal data.

12. CHANGES TO THESE TERMS AND CONDITIONS

  • 2.1. These Terms and Conditions will be updated from time to time as necessary.
  • 12.2. Each time you create an order, the Terms and Conditions will be the then current Terms and Conditions. 

13. OTHER DATA OF INTEREST

  • 13.1. These Terms and Conditions are governed by Spanish law and shall be construed in accordance with Spanish law. This means that the order for the purchase of Products through our Website, and any dispute or claim arising out of or in connection with it, shall be governed by Spanish Law.
  • 13.2. You and We both agree that disputes, if any, arising out of the interpretation, validity and/or enforceability of these Terms and Conditions shall be subject to the jurisdiction of the Courts of Barcelona, Spain.

17. APPLICABLE LAW AND JURISDICTION

  • 17.1. These Terms and Conditions are regulated by Spanish law and must be interpreted by Spanish law. This means that the contract for the purchase of Products through our Web Site, and any dispute or claim that arises from or in connection with it, will be governed by Spanish Law.
  • 17.2. You and we both agree that the conflicts that, where appropriate, cause the interpretation, validity, and/or execution of these Terms and Conditions will be submitted to the jurisdiction of the Courts of Barcelona, Spain.
